1. Agreement
By renting a dumpster from All-American Dumpsters LLC (“Company”), the customer (“Customer”) agrees to the following terms and conditions. This agreement is governed by the laws of the State of Florida.
2. Services Provided
The Company agrees to provide the Customer with non-hazardous solid waste collection, transportation, disposal, and recycling services. The Customer must provide at least one to two (1-2) business days’ notice for dumpster delivery, exchange, termination, or relocation. Requests received after 12 p.m. (noon) may not be serviced until the next business day. Delays may occur due to inclement weather, traffic conditions, equipment failure, or other unforeseen circumstances.
3. Prohibited Waste
The Customer agrees not to place any hazardous or toxic waste in the dumpster, including but not limited to industrial waste, asbestos-containing materials, paint, cleaning solutions, biomedical waste, pesticides, solvents, automotive parts, tires, oil, batteries, appliances with Freon, electronics, and any other materials classified as hazardous under local, state, or federal law. Discovery of such materials will result in the Customer being responsible for all associated removal and disposal costs, as well as potential fines and legal action.
4. Access and Placement
The Customer shall provide unobstructed access to the equipment on the scheduled pick-up day. The Company is not responsible for any damage to the Customer’s property, including walkways, curbing, pavement, driveways, pavers, irrigation systems, wells, septic systems, or underground utilities resulting from the provision of services. The Customer warrants that the right of way is sufficient to bear the weight and physical dimensions of the Company’s equipment and vehicles.
5. Overfilled or Overweight Dumpsters
The Customer agrees not to overfill the dumpster beyond its top rail. Overfilled dumpsters may cause debris to fall out and are illegal to transport. The Company reserves the right to refuse pick-up of overfilled dumpsters. If a dumpster is overfilled or exceeds weight limits, the Customer will be responsible for removing excess debris and may incur additional fees.
6. Rental Period and Additional Days
The standard rental period is three (3) days. Each additional day is charged at $19.99. The Customer must notify the Company in advance if an extension is required. Failure to do so may result in additional fees or removal of the dumpster without notice.
7. Payment Terms
Payment is due upon ordering the dumpster unless otherwise agreed upon in writing. The Customer agrees to pay all charges associated with the rental, including any additional fees incurred due to prohibited materials, overfilled or overweight dumpsters, or extended rental periods.
8. Indemnification
The Customer agrees to indemnify, defend, and hold harmless the Company from any and all liability arising from the Customer’s use of the dumpster, including but not limited to bodily injuries, property damage, or violations of law.
9. Modifications
The Company reserves the right to modify these terms and conditions at any time without prior notice. The Customer agrees to be bound by the most current version of these terms upon rental.
10. Governing Law
These terms and conditions are governed by and construed in accordance with the laws of the State of Florida. The Customer irrevocably submits to the exclusive jurisdiction of the courts in that state.
